- Background: Aboriginal and Torres Strait Islander people, and members of other minority groups, are disproportionately affected by racial profiling, excessive use of force, and other forms of police misconduct in Australia. This issue contributes to over-incarceration, deaths in custody, and a deep mistrust of law enforcement.
- Legal Strategy: This campaign supports a multi-pronged approach: (1) Supporting civil actions by individuals who have been subjected to unlawful police conduct, seeking damages for assault, battery, false imprisonment, and racial discrimination; (2) Bringing complaints to relevant oversight bodies, such as the Law Enforcement Conduct Commission (NSW) or equivalent bodies in other jurisdictions; (3) Supporting systemic litigation to challenge discriminatory policing practices, potentially relying on the Racial Discrimination Act 1975 (Cth); (4) Advocating for policy changes, such as independent investigations of police misconduct, increased police accountability, and improved training on cultural awareness and de-escalation techniques.
